These terms and conditions shall apply to all contracts for the sale of goods by the seller to the buyer and shall prevail over any other documentation or communication from the buyer. Our Website is only intended for use by customers resident in England, Wales, Scotland and Northern Ireland (the United Kingdom). We reserve the right to revise and amend the Website, our disclaimers and the Conditions at any time. Ordering All orders for goods shall be deemed to be an offer by the buyer to purchase goods congruent these terms and conditions and are subject to acceptance by the seller. A contract between you and Jacwicks Designs Limited will only take place once the order has been accepted, processed and items despatched. The seller may choose not to accept an order for any reason. All goods are produced as limited stock. All care is taken to ensure stock shown on the website is correct if an error occurs Jacwicks Designs Ltd cannot be held be responsible for variations in colour between pictures and fabric. If goods ordered by the buyer are not available from stock, the buyer shall be notified and given the option to either choose a different design, or cancel the order and receive a full refund within 30 days. Ownership of the goods will only pass to you when we receive full payment of all sums due in respect of them including the cost of delivery. Acceptance of delivery of the goods shall be deemed conclusive evidence of the buyer's acceptance of these terms and conditions. Special Order Items Any items ordered specially for you, such as those sourced outside our usual stock, or custom made, are non-returnable and you will be informed of this and have the option to cancel when your order is processed. Any non-stock or special products must be paid for at time of order, unless agreed in writing prior to order acceptance. Cancellation must be made on the same day the order is placed or processed and this MUST be done by telephone on 07969350638. Pricing All goods offered for sale by Jacwicks Designs are priced in pounds Sterling and are inclusive of VAT, but exclusive of postage and packing charges unless otherwise stated. The total purchase price, including VAT and delivery charges, will be displayed in the buyer's shopping basket prior to confirming the order. Occasionally, despite our best endeavours products appear mispriced, however we verify prices as part of our order processing. If the correct price is higher, we would normally contact you to advise you and request instructions before despatch or cancel the order and notify you accordingly. Payment We accept online payments through a secure environment by Square or PayPal and are shown in pounds Sterling. Payment of the price plus VAT and delivery charges must be made in full before dispatch of the goods. Our on-line payments facility is operated through PayPal to ensure your transaction is secure and the encryption of your personal data means that it cannot be read by anyone else. We do not retain any credit card details after the transaction has been completed. Do not email your card details. No responsibility can be taken for security if you provide your details in this way. Card fraud is illegal and will always lead to prosecution. Delivery Postage is by either: EVRi, Royal Mail 2nd Class or Parcelforce depending on the size, weight and value of the item. We aim to dispatch products within 3-5 working days, Monday-Friday, of cleared payment, when exceed theses dates the seller will contact the buyer to notify them of the delay and given the option to either wait until the goods are available from stock, or cancel the order and receive a full refund within 30 days. Any date of delivery given by the Seller to the Buyer shall be an estimate date only and while the Seller will endeavour to comply with any such date, the Seller shall not be responsible for late delivery and time of delivery shall not be of the essence of the Contract. The goods will be at your risk from the time of delivery. Without prejudice to the generality of the forgoing, the Seller shall not be liable for late delivery or failure to deliver through any cause which is beyond the reasonable control of the Seller. Cancellation and Return The buyer shall inspect the goods immediately upon receipt and shall notify the seller via email within 48 hours of delivery if the goods are damaged or do not comply with any of the contract. If the buyer fails to do so, the buyer shall be deemed to have accepted the goods. Where a claim of defect or damage is made, the goods shall be returned by the buyer to the seller, along with written details of the defect or damage. The buyer shall be entitled to a full refund (including delivery costs) if the goods are defective. The buyer has the right to cancel the contract at any time up to the end of fourteen days after the goods are received. Goods must be returned by the buyer at the buyer’s expense and should be adequately insured during the return journey. The item must be returned unused we reserve the right to reduce or cancel the refund where goods have been deliberately damaged. The buyer will receive a refund of all monies paid for the goods (excluding all delivery and return charges) within 30 days of cancellation. All refunds will be returned in the same method as payment was given. If the buyer fails to return the goods within 30 days following cancellation, the seller shall be entitled to deduct the costs of recovering the goods from the buyer. Unfortunately, orders and items which have been customised cannot be returned.
